By accessing or using Blink ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the Service.
2. Description of Service
Blink provides an ephemeral image sharing service that allows users to upload images which are automatically deleted after 60 seconds. The Service is available through our website and Android application.
3. User Responsibilities
By using Blink, you agree to:
- Only upload images you have the right to share
- Not upload illegal, harmful, or offensive content
- Not use the Service to harass, abuse, or harm others
- Not attempt to circumvent any security measures
- Not use automated tools to access the Service
- Comply with all applicable laws and regulations
4. Prohibited Content
You may not upload content that:
- Is illegal or promotes illegal activities
- Contains child sexual abuse material (CSAM)
- Depicts violence or promotes terrorism
- Infringes on intellectual property rights
- Contains malware or malicious code
- Violates another person's privacy rights
- Is discriminatory, hateful, or harassing
We reserve the right to remove any content and terminate access for users who violate these terms.
5. Usage Limits
The Service may impose usage limits, including:
- Maximum file size of 5MB per image
- Daily upload limits (5 uploads per day on Android, with option to unlock more)
- Rate limiting to prevent abuse
6. Intellectual Property
You retain ownership of all images you upload. By uploading an image, you grant Blink a limited, temporary license to store and transmit the image for the sole purpose of providing the Service.
The Blink name, logo, and all related branding are the property of Darkmintis and may not be used without permission.
7. Disclaimer of Warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. WE DO NOT GUARANTEE THAT:
- The Service will be uninterrupted or error-free
- Images will be successfully deleted after 60 seconds
- The Service will meet your requirements
- Any data transmitted will be secure
8. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, BLINK SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR GOODWILL.
9. Indemnification
You agree to indemnify and hold harmless Blink and its affiliates from any claims, damages, or expenses arising from your use of the Service or violation of these Terms.
10. Modifications
We reserve the right to modify these Terms at any time. Changes will be effective immediately upon posting. Your continued use of the Service after changes constitutes acceptance of the modified Terms.
11. Termination
We may terminate or suspend your access to the Service at any time, without notice, for any reason, including violation of these Terms.
12. Governing Law
These Terms shall be governed by and construed in accordance with applicable laws, without regard to conflict of law principles.
